بَرّا منصة وسيطة تقنية تربط الزبون بالمطاعم المسجلة، وتُسهّل عرض القائمة وإرسال الطلب وتتبّعه. بَرّا ليست بائعاً، ولا طرفاً في عقد البيع بين الزبون والمطعم، ولا تمتلك أو تُحضّر أو تُسلّم أي طعام.
Barra is a technology platform that connects customers with registered restaurants and facilitates menu display, order submission, and tracking. Barra is not the seller, is not a party to the sale contract between customer and restaurant, and does not own, prepare, or deliver any food.
The restaurant is the actual seller and is fully responsible for food quality, safety, preparation, and delivery. The customer is the buyer responsible for the accuracy of their information and purchase decisions. Barra does not intervene in payments between the parties and does not receive any funds on behalf of the restaurant.
بَرّا تتحمل المسؤولية فقط عن الأخطاء التقنية الناتجة من جهتها مباشرة (مثل تعطّل التطبيق، فقدان بيانات بسبب خلل تقني في خوادمنا، أو خطأ برمجي في احتساب الإجمالي قبل الإرسال).
بَرّا غير مسؤولة عن أي ضرر أو نزاع أو خسارة ناتجة عن:
Barra is liable only for technical errors directly caused by our side (e.g., app outage, data loss due to a technical fault in our servers, or a programming bug in pre-submission total calculation).
Barra is not liable for damages, disputes, or losses arising from: misuse of the app by any party; food quality, ingredients, safety, or preparation delays; conduct of restaurant staff, drivers, or customers; accidents during pickup or delivery; payment disputes between customer and restaurant; content published by the restaurant; or service interruption due to circumstances beyond our control.
بتفعيل حساب المطعم على بَرّا، يوافق صاحب المطعم على ما يلي:
By activating a restaurant account on Barra, the owner agrees to:
1. Price matching: Item prices inside the Barra app must exactly match prices inside the physical store. Any unjustified price manipulation in the app is a material breach of this agreement.
2. Accurate information: Item names, photos, ingredients, add-ons, working hours, phone, and location must be accurate and up to date.
3. Full responsibility: The restaurant assumes full responsibility for food quality and safety (per SFDA regulations), ZATCA tax-invoicing compliance, on-time order preparation and delivery, direct handling of customer complaints, and all conduct of its staff and drivers.
4. Licensing: The restaurant must be licensed and commercially registered under Saudi law.
⚠️ Price-mismatch enforcement: If Barra detects — or receives a documented customer report of — a price discrepancy between the app and in-store, Barra may issue a written warning, and ultimately suspend the account and cancel the subscription without refund, plus pursue legal compensation.
Customers must provide accurate registration information, refrain from unlawful or fraudulent use, treat staff and drivers respectfully, pay the restaurant directly upon pickup/delivery, refrain from hacking or abusing the service, and take responsibility for every order placed from their account.
عملية الدفع تتم مباشرة بين الزبون والمطعم (نقداً عند الاستلام، أو عبر وسيلة دفع يقدّمها المطعم نفسه). بَرّا لا تتدخّل في الدفع، ولا تستلم مبالغ من الزبون، ولا تتحمّل أي مسؤولية مالية عن النزاعات بين الطرفين.
إذا حدث خطأ في الإجمالي المعروض في التطبيق بسبب خلل تقني من جهتنا، فإن مسؤوليتنا تنحصر في تصحيح الخلل، ولا تشمل تعويض الفرق بين السعر المعروض والسعر الفعلي — هذا الفرق يُحلّ مباشرة بين الزبون والمطعم.
All payments occur directly between customer and restaurant (cash on pickup/delivery, or via a payment method the restaurant itself provides). Barra does not handle payments, does not collect funds from customers, and is not liable for financial disputes between the parties.
تحتفظ بَرّا بحقها في إيقاف أو إلغاء أي حساب (زبون أو مطعم أو موظف) في الحالات التالية، بدون إشعار مسبق إذا اقتضى الأمر:
في حالة الإلغاء بسبب مخالفة جوهرية، لا يحق للمستخدم استرداد أي مبالغ مدفوعة (مثل اشتراكات المطاعم).
جميع حقوق الملكية الفكرية للتطبيق (الاسم، الشعار، التصميم، الكود البرمجي، المحتوى التشغيلي) محفوظة لـ بَرّا. لا يجوز نسخ أو إعادة استخدام أو نشر أي عنصر منها دون إذن كتابي مسبق.
المحتوى الذي يرفعه المطعم (صور الأصناف، الأوصاف) يبقى ملكاً للمطعم، لكنه يمنح بَرّا ترخيصاً غير حصري لاستخدامه ضمن المنصة.
تحتفظ بَرّا بحقها في تعديل هذه السياسة في أي وقت. ستُنشر أي تعديلات على هذه الصفحة مع تحديث تاريخ السريان. استمرارك في استخدام التطبيق بعد التعديل يُعدّ موافقة على البنود الجديدة.
تخضع هذه السياسة لأنظمة المملكة العربية السعودية، وتختص المحاكم السعودية بالنظر في أي نزاع ينشأ عنها.
These terms are governed by the laws of the Kingdom of Saudi Arabia, and Saudi courts have exclusive jurisdiction over any disputes arising hereunder.
